Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. El presente artículo recoge resultados de la investigación adelantada en el Estado del arte sobre la enseñanza de la historia en la educación infantil, que abarco una revisión bibliográfica de lo que circula entre los años 2006-2016 en la ciudad de Bogotá. En ella interesaba conocer las perspectivas, problemas y avances que se ubican en la formación del educador infantil, en lo que se enseña a niños y niñas sobre los aspectos temporales asociados a la iniciación del pensamiento histórico. Aquí (...) sólo presentaremos una de las categorías encontradas, que alude a las elecciones sobre el qué enseñar en la educación infantil a propósito de la historia. En este aspecto se encontraron tres asuntos que permiten generar apuestas sobre la enseñanza de la historia y del pensamiento histórico en las edades iniciales: la experiencia del tiempo en la enseñanza de la historia; el abordaje de los objetos como pretextos históricos; y la comprensión del tiempo sin aludir al contenido histórico. Although substantial evidence suggests receiving social support has positive implications for well-being, less is known about how providing support can confer benefits, particularly for Asian American and Latinx individuals who are more likely to come from interdependent cultures that emphasize family obligation. Asian American and Latinx college students reported on anxiety before taking part in a modified laboratory task that elicited a physiological stress response as measured by total cortisol output. They were randomly assigned to write a supportive note to (...) a family member, a supportive note to a close friend, or about their day in a control condition after the mild lab stressor and reported on psychosocial well-being. Those who provided support to a family member experienced higher self-esteem compared to those in the control condition. However, there was variation in Asian American and Latinx participants’ physiological stress response. The findings suggest that providing support to close others, particularly family members, can be differentially meaningful for individuals from diverse backgrounds. (shrink)

O reconhecimento é um conceito normativo. Ao reconhecermos alguém como portador de determinadas características ou capacidades, reconhecemos seu status normativo e estamos assumindo responsabilidade por tratar este alguém de determinada forma. O não reconhecimento, neste caso, pode significar privação de direitos e marginalização; em uma democracia pode impossibilitar indivíduos ou grupos de desfrutar o ideal igualitário democrático, por exemplo. Nas últimas três décadas, a reflexão sobre esta categoria se aprofundou e assumiu maior importância no debate entre liberalismo e comunitarismo em (...) paralelo às demandas, por vezes pelas conquistas, de grupos e minorias que se sentem não reconhecidos e se engajam em movimentos políticos através de lutas por reconhecimento. Retomaremos, aqui, o desenvolvimento do conceito de “eticidade” empreendido por Axel Honneth em Luta por reconhecimento, obra fundamental para a reflexão sobre o tema. O autor situa sua teoria no meio termo entre a moral kantiana e as éticas comunitaristas: sua concepção é formal por entender que normas universais são condições de algumas possibilidades, mas é substantiva por se orientar pelo fim da autorrealização humana. Qualitative studies on assisted reproductive technology commonly focus on the perspectives of participants living in major metropolises. In doing so, the experiences of those living outside major cities, and the unique way conditions of spatiality shape access to treatment, are elided. In this paper, we examine how location and regionality in Australia impact upon access and experience of reproductive services. We conducted twelve qualitative interviews with participants residing in regional areas across Australia. We asked participants to discuss their experience with (...) assisted reproduction services and the impacts of location on access, service choice, and experience of care, and analysed the data using reflexive thematic analysis, as outlined by Braun and Clarke (2006, 2019). Participants in this study reported that their location impacted the services available to them, required considerable time in travel, and reduced continuity of care. We draw on these responses to examine the ethical implications of uneven distribution of reproductive services in commercial healthcare settings which rely on market-based mechanisms. (shrink)

The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Este trabajo propone explicar, a partir de la metodología propuesta por la Comisión Europea en el “Manual para la Perspectiva de género”, por qué las mujeres rurales víctimas del conflicto armado en Colombia se constituyen como un grupo especialmente vulnerabilizado y cuáles son las principales barreras a las que se enfrentan al momento de reclamar su derecho a la restitución de tierras, específicamente en los programas que se vienen desarrollando en el marco de la Ley 1448 de 2011.

This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. ABSTRACT This cross-sectional study compared the moral reasoning of first-year and third-year doctoral students in clinical psychology. Nineteen first-year and 20 third-year students were recruited from 17 doctoral training programs in the UK. Most adopted a sophisticated approach to moral judgments, as assessed by the Defining Issues Test, although, surprisingly, more experienced students had significantly less sophisticated schemata. In their moral judgments, less experienced students relied more heavily on their personal, and more experienced students on their professional, constructs, as assessed (...) by repertory grid technique. ANGIE PEPPER | : This paper attempts to bring some clarity to the debate among sentientists, biocentrists, and ecocentrists on the issue of who or what can count as a candidate recipient of justice. I begin by examining the concept of justice and argue that the character of duties and entitlements of justice sets constraints on the types of entities that can be recipients of justice. Specifically, I contend that in order to be a recipient of justice, one must (...) be the bearer of enforceable moral claim rights. I then suggest that this has important implications for the dispute among sentientists, biocentrists, and ecocentrists. In brief, I show that sentientists cannot exclude nonsentient entities from the domain of justice merely by denying that they have “the right kind of interests,” and biocentrists and ecocentrists cannot move seamlessly from some feature of living things or ecosystems to entitlements of justice. I further argue that ultimately this disagreement on the bounds of justice bottoms out in a normative disagreement about which entities possess moral claim rights, and that the case for biotic or ecosystem rights has yet to be convincingly established. | : Le présent article vise à clarifier le débat parmi sentientistes, biocentristes et écocentristes autour de la question de qui ou de ce qui peut valoir comme un récipiendaire légitime de justice. This book chronicles the influence of second wave feminism on everything from electoral politics to LGBTQ rights. The original descriptions of second wave feminism focused on elite, white voices, obscuring the accomplishments of many activists, as third wave feminists rightly criticized. Those limited narratives also prematurely marked the end of the movement, imposing an imaginary timeline on what is a continuous struggle for women’s rights. Within the chapters of this volume, scholars provide a more complex description of second wave feminism, (...) in which the sustained efforts of women from many races, classes, sexual orientations, and religious traditions, in the fight for equality have had a long-term impact on American politics. These authors argue that even the “Second Wave” metaphor is incomplete, and should be replaced by a broader, more-inclusive metaphor that accurately depicts the overlapping and extended battle waged by women activists. With the gift of hindsight and the awareness of the limitations of and backlash to this “Second Wave,” the time is right to reflect on the feminist cause in America and to chart its path forward. In virtue of their capacity for political agency, political agents can possess special rights, powers, and responsibilities, such as rights to political participation and freedom of speech. Traditionally, political theorists have assumed that only cognitively unimpaired adult humans are political agents, and thus that only those humans can be the bearers of these rights, powers, and responsibilities. However, recent work in animal rights theory has extended the concept of political agency to nonhuman animals. In this article, I develop an account (...) of political agency that identifies the capacities that one must possess to be a political agent and captures the fact that political action is a distinctive type of action. Crucially, this account makes sense of the standard assumption that only some humans count as political agents, and explains why few nonhuman animals, human infants, and severely cognitively impaired humans are likely to possess the capacity for political agency. I go on to reject the view, recently advanced by Sue Donaldson and Will Kymlicka, that nonhuman animals can be ‘nonintentional political agents’. I conclude by suggesting that most nonhuman animals, as well as human infants and humans with severe cognitive impairments, cannot straightforwardly be assigned rights to political participation. In this paper, I defend the claim that many sentient nonhuman animals have a right to privacy. I begin by outlining the view that the human right to privacy protects our interest in shaping different kinds of relationships with one another by giving us control over how we present ourselves to others. In order to arrive at a coherent understanding ofthe Dialogues as a whole (...) and perhaps also to calm the sense of bafflement which the confrontation with this enigmatical text always provokes, many Hume scholars have taken as a point of departure and clue for unravelling it either one or two of Hume's principal philosophical doctrines or a presumedly unitary view of Hume's philosophy in general. Equipped with one or both of these instruments, they proceed to dissect the arguments of the Dialogues with the intention of determining what Hume's position really is. This task also almost invariably ends by assigning the victory in the dialectical struggle and the representation of the author's 'true' opinions to the character (sometimes even more than one) in whom they are more or less able to find the purest expression ofwhat theyhave previously decided is the kernel oressence ofHume's philosophy. Franco-Ferraz has taken a very different route. For her the key point of the Dialogues lies in the fictional setting in which the theological discussion takes place. She goes on to show that the literary form of the Dialogues is intrinsically connected with its philosophical content so as to serve to elucidate the precise nature ofthe conclusion which is established at the end, in Part XII. In other words, the theatrical structure facilitates a more profound and detailed investigation ofthe problems dealing with the existence and nature of God. This is an exploration of women’s tradition of hospitality, the epistemic and moral contribution of their practices of welcoming the other and their historical experience as providers of care. The essay claims that female hospitality has largely consisted of care for others, which challenges a social model based on individualism and self-sufficiency. The argument is rooted in ethnography and Jewish thought and reclaims the home as an ethical space. This text analyses two disturbing and painful stories from the Tanakh that (...) are both examples of the consequences of extreme or absolute hospitality and violence against women. The famous works of Jacques Derrida and Emmanuel Lévinas on hospitality as ethics and hospitality as the feminine are discussed vis-à-vis anthropological and feminist approaches to the connection between the female welcoming of the other and the ethics of care. Finally, the reflections of the members of Beit Midrash Arevot shed light on a traditionist feminism that develops an ethics and practice of hospitality as welcoming otherness. (shrink)

Resumen El objetivo principal del presente trabajo es analizar la atenuación en los actos asertivos en entrevistas sociolingüísticas a fin de entender cómo se construye la imagen de afiliación en la cultura mexicana. En este trabajo la imagen de afiliación se define como el deseo de ser aceptado por un grupo. Nos interesa determinar si la realización de estos actos asertivos son amenazas eventuales a la imagen social de los informantes y si tienen una función atenuadora. El corpus que se (...) analizó consistió en segmentos seleccionados de 12 entrevistas, 6 de hombres y 6 de mujeres, del corpus oral “El habla de Monterrey–PRESEEA” correspondientes a informantes entre 35 y 54 años que concluyeron sus estudios de licenciatura. El análisis de este corpus oral muestra aspectos importantes, a saber, nos presenta que existen similitudes y diferencias entre los dos grupos pues tanto hombres como mujeres utilizaron la justificación para atenuar su punto de vista. En cuanto a diferencias, las mujeres emplearon más estrategias de atenuación que los hombres. Por otra parte, el análisis de los datos sugiere que la atenuación, como categoría pragmática, contribuye a caracterizar la imagen de afiliación de nuestros informantes. (shrink)

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

This thesis focuses on the evolution of human social norm psychology. More precisely, I want to show how the emergence of our distinctive capacity to follow social norms and make social normative judgments is connected to the lineage explanation of our capacity to form shared intentions, and how such capacity is related to a diverse cluster of prototypical moral judgments. I argue that in explaining the evolution of this form of normative cognition we also require an understanding of the developmental (...) trajectory of this capacity. For this purpose, the thesis is organized as follow. In the first chapter, I make some methodological remarks and provide the general overview and plan for the dissertation. In the second chapter, I explain what my explanatory target is and why it matters. On the view I am defending, shared intentional psychology gives rise to a special form of psychology that enables us to engage in social normative thinking. These norms are represented as shared intentional states. Moral psychology, in contrast, is more diverse. For moral judgments define a quite heterogeneous class of mental states—although some moral judgments may involve the representation and execution of norms, certainly not all of them do. I show that although much of our distinctive social norm psychology can be explained within the framework of shared intentionality, moral judgments cannot be unified in the same way. In the third chapter, I provide the baseline of social-cognitive capacities that serve as starting point for my lineage explanation. I argue that hominin social cognition was for a very long period of our evolutionary history essentially a matter of low-level cognitive and motivational processes. On this picture, bottom-up affective processes regulated the social lives of early hominins without requiring any special top-down mechanism of normative thinking such as a capacity for understanding and representing social norms. In the fourth chapter, I argue that human-like social norm psychology evolved as a result of the selective pressures that gave rise to shared intentionality, especially the demands that came from collective hunting. Yet collective hunting was not the whole story of the evolution of shared intentionality, for our capacity to form shared intentional mental states emerged from the interplay between the selective pressures that led to cooperative breeding in humans as well as organized, goal-oriented, collective hunting. Thus, I propose an evo-devo account of shared intentionality and its normative dimension since I argue that explaining the evolution of this particular form of normative thinking crucially depends on information about the developmental trajectory of this capacity. Finally, in the fifth chapter, I focus on how social norms are acquired and how the way we learn them gives rise to some prototypical cluster of moral judgments. Thus, this chapter returns to some of themes and arguments of the first chapter by explaining how the distinction between moral judgments and nonmoral judgments can be culturally transmitted. Peer competition and peer cooperation can be intuitively seen as opposing phenomena. However, depending on multiple factors, they might be complementary. In a population divided into groups, for instance, members of each group may cooperate with their peers in order to compete with neighboring groups. Alternatively, they may compete with their peers as a means of choosing the best cooperative partners and demonstrate that they are reliable cooperative partners. For instance, if subjects can choose with whom they wish to interact, (...) this may create competition to be more generous or loyal than others. (shrink)

In this article, I expand the existing discourse on climate justice by drawing out the implications of taking animal rights seriously in the context of human-induced climate change. More specifically, I argue that nonhuman animals are owed adaptive assistance to help them cope with the ill-effects of climate change, and I advance and defend four principles of climate justice that derive from a general duty of adaptation. Lastly, I suggest that even if one can successfully argue that the protection of (...) human interests in adaptation ought to be prioritised, nonhuman animal rights will continue to place significant constraints on climate change action. In a recent article in Sociology, Diane Richardson contends that rather than focusing on theorizing the specific relationship between sexuality and gender, researchers should focus on developing frameworks that capture the complex and dynamic nature of that relationship. Towards that end, Richardson proposes ‘patterned fluidities’ as a working metaphor for feminine sexuality. This article explores the potential of the metaphor as a focal point for bringing together different strands of feminist thought on heterosexuality. It discusses if and how ‘patterned fluidities’ (...) are supported by empirical evidence and how they interact with areas of thought that do not fall within the scope of Richardson’s article, namely feminist views on postmodernity. Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

As an independent researcher, registered social worker and erstwhile long-term, long-distance carer, the care of older people and protection of elders from abuse had been constant professional and personal foci for me for many years. Commissioned to review a case involving the serious abuse of an elder where official safeguarding procedures had not been used, I puzzled why this had been managed ?informally? by social services and partner agencies (i.e. outside adult safeguarding procedures), with vague unspecified ?monitoring? (AEA 2006). Why (...) was there this apparent gap between policy intention and implementation? That question led to research on which this essay is based. (shrink)

Ampliando las resonancias de la fórmula nietzscheana que da nombre a la segunda de sus consideraciones intempestivas, en las que el golpe de martillo recae sobre la utilidad y el perjuicio de la historia para la vida, intentamos esbozar una clave de lectura que permita recorrer los diversos envites de este libro desde la atención al malestar que se aloja hoy en la universidad, anudado a su devenir corporativo y a la gramática de una existencia sofocada por el lenguaje_ _del neoliberalismo. Viendo resquebrajarse la idea que la universidad tenía de sí misma, su transformación exige a quienes la habitamos volver a tensar los hilos que la anudan con la vida y con la muerte, para no conceder simplemente a las prácticas que, por los poderes y lógicas que la asedian y conforman, esta institución actualmente alberga. Si la vida queda excluida de la universidad, como vislumbra Walter Benjamin en su ensayo temprano sobre _La vida de los estudiantes, _la tarea recae en activar las facultades de la contienda para inventarse una nueva, _otra _universidad posible, una en la que el pensamiento, la imaginación y el deseo puedan volver a rastrillar lo que queda de porvenir en la memoria de ese nombre. _Palabras Clave: _Universidad – Vida – Neoliberalismo – Crítica. This article contributes to the limited literatures on small- and medium-size enterprises and corporate social responsibility. Using an institutional theoretical framework, we analyzed fieldwork interviews with twenty SMEs and perspectives of 165 SME managers and workers in textiles, garment, and footwear industries, the most important wage-earning sector in Vietnam. Having understood in the context of a developing “market economy with socialist orientation”, we find that socially responsible practices and expectations developed long before the arrival of CSR as a western concept (...) and an MNC agenda. While identifying and contributing ideas concerning forms of “informal” CSR practices—influenced by social and cultural expectations—to the CSR/sme literature, we are conscious of the mixed effects of these practices and the ongoing nuanced negotiations between workers and managers in these SMEs. In our research, we found that it takes both domestic and international stakeholders to improve labor conditions in Vietnam under the banner of CSR. (shrink)
